Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, do not use the Site. If you are using the Site on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

Our Services

K&M Auto Center provides auto damage estimating, vehicle valuation, and pre-purchase inspection services — delivered virtually or in person — to body shops, dealerships, fleet operators, and individual owners. The Site is informational in nature; it is not an offer to provide services to any particular party. Any work we perform will be governed by a separate written service agreement, work order, or accepted quote, which controls in the event of conflict with these Terms.

Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Violate any applicable law, regulation, or third-party right;
• Attempt to gain unauthorized access to the Site, related systems, or other users' accounts;
• Interfere with or disrupt the Site, including by introducing malware or excessive automated requests;
• Scrape, harvest, or systematically extract data from the Site without our prior written consent;
• Reverse engineer or attempt to derive source code from any portion of the Site;
• Use the Site to transmit unsolicited or unauthorized advertising or promotional material;
• Misrepresent your identity or affiliation with any person or entity.

Intellectual Property

The Site and all of its contents — including text, graphics, logos, images, the “K&M Auto Center” name and brand, methodologies, frameworks, and software — are owned by K&M Auto Center or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal or internal business reference. All other rights are reserved. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or republish any part of the Site without our prior written permission.

User Submissions

If you submit information through the Site — for example, by completing a contact form, submitting a job, uploading photos or video, or emailing us — you represent that the information is accurate, that you have the right to share it, and that doing so does not violate any third party's privacy or contractual rights. By submitting, you grant us a non-exclusive, royalty-free license to use that information to respond to your inquiry, complete the report or service you've requested, and improve our offerings, subject to our Privacy Notice.

Do not submit confidential or proprietary information through the Site unless we've signed an appropriate agreement. Communications and uploads submitted through unsecured channels may be reviewed by our team and processed by service providers.

Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. Any turnaround times, sample reports, accuracy figures, or testimonials presented on the Site are illustrative averages and outcomes; they are not guarantees that any particular job will be completed in the same time frame, at the same cost, or with the same outcome.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, K&M AUTO CENTER, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). The foregoing limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless K&M Auto Center and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by K&M Auto Center. We are not responsible for the content, privacy practices, or practices of any third-party site or service. Your use of any such site is at your own risk and subject to the terms and policies of the operator.

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the rights and licenses granted to you under these Terms will end, and Sections 4 through 11 will survive.

Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision.

Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page, with the “Last Updated” date noted at the top. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
